Waiver of Liability and Release Form

 

All students must complete this Waiver before participating in any lessons or certification courses with Lifeguarding Academy Corporation (the “Company”). If the Student is under the age of 18, a parent or guardian must sign the Intake Form acknowledging this Waiver on behalf of the Student. Admission to the lessons or certification course will not be permitted if this Waiver is not complete and received by the Company prior to the lesson and/or is insufficiently signed or dated.

The Student has freely and voluntarily chosen to participate in the lessons or certificate course and understands that depending on the nature of the lessons or certificate course, a certain level of fitness and ability is required. The Student represents and warrants that they are in good physical condition, able to swim at a proficient level, and have no medical condition, consideration, and/or allergies that would prevent and/or limit their full participation. The Student further agrees to observe and obey all posted and spoken rules, warnings, and oral instructions provided by the Company and by extension the Instructor. If, however, the Student observes any unusual hazards, the Student understands it is their responsibility to remove themselves and bring such attention to the Company.

This Waiver of Liability releases any liability and assumes all risks associated with the Student’s participation in the lessons, certificate course and related activities. The Student fully understands there is an inherent level of risk of physical and/or psychological injury that may present itself throughout the lessons or certification course, whether known or unknown, and the Student fully assumes those risks involved. These risks include but are not limited to, potential negligence or carelessness on the part of the Company and Instructor, dangerous or defective equipment, physical and strenuous exertion, minor injuries such as scratches, bruises, and sprains, slips, falls, joint or back injuries, broken bones, concussions, loss of eyesight, faiting, or catastrophic injuries such as heart attacks, paralysis, drowning, and/or death.

The Student understands and confirms that they have provided consent on the Intake Form freely, voluntarily, under no duress or threat of duress, without inducement, promise, or guarantee being communicated to them and that they have read and accepted the terms and have given up considerable future legal rights. Such consent on the Intake Form is proof of the Student’s intention to execute a complete and unconditional Waiver of Liability and release all liability to the fullest extent of the law.
